The conditions of participation in the version valid at the time of registration are part of the contract between the Wechselszene Sven Hindl GmbH and the participants.

2. Registration, entry fees, service
2.1 The respective service object of the organizer is the implementation of the respective event for which the participant has registered.
2.2 Registration for the respective event is possible up until the registration deadline specified in the announcement as an online registration via our website www.chiemsee-triathlon.com, provided that the maximum number of participants has not yet been reached. The contract between the participant and the organizer comes into effect when the registration confirmation is sent, which is sent by email immediately after registration.
2.3 If the maximum permitted number of participants has already been reached before the registration deadline specified in the announcement, the registration will be closed early. Further registrations for this event are then no longer possible.
2.4 Before the respective event, the participant will be sent an email with all relevant information about the event to the email address provided by the participant when registering.
2.5 In the case of a group registration, the registrant guarantees that he/she is authorized to register and enter the personal data of all group members and to make all statements for the group members. The applicant will inform all group members of the conditions of participation and the data protection regulations.
2.6 Registrations for minors or limited legal capacity for the events permitted for them are only permitted by their legal representatives. A corresponding exemption from liability and the consent of a legal representative must be signed and sent to the organizer in advance by post or email. If the bib number is collected on site, it must also be accompanied by a legal representative.
2.7 The participation fee specified in the registration applies. The payment of the participation fee and the fees for correspondingly selected additional services can be made either by SEPA direct debit, paypal or credit card.
2.8 If the participant declares that he/she does not want to stick to the contract for participation in an event (e.g. through a declaration of termination or withdrawal), or cancels participation in the event or stays away from the event without cancellation (no-show), this applies as a final waiver of the start or participation in the event, regardless of whether the participant is entitled to do so.
There is no right to a refund of the entry fee. This also applies if the participant is excluded in accordance with point 4.1 of the Conditions of entry or in the event of disqualification.
Any additional services booked can be transferred to a subsequent or replacement event or reimbursed. This requires written notification (by post or e-mail) to the organizer, which must be received on the day of the event at the latest.

2.10 In the event of a cancellation of the event for which the organizer is not responsible (e.g. due to storms, terror, epidemics, war, natural forces, official orders and the Covid 19 pandemic), there is the option of canceling the starting place without an additional processing fee to transfer a follow-up event as part of the Chiemsee Triathlon if the maximum number of participants has not yet been reached. Any additional services booked can also be transferred to a subsequent event or reimbursed. In the case of a transfer from the Olympic distance to the half distance, the difference fee must be paid. In the event of a transfer from half distance to Olympic distance, the difference will not be refunded.
If a transfer to a subsequent event is not possible, the participation fee and the fee for any additional services booked will be reimbursed. However, the amount paid for specially designated events to cover the costs of organizing and preparing the event against the background of the unforeseeable consequences of the Covid 19 pandemic, without which the event would not have been possible for us, will not be reimbursed.
2.11 If the event is canceled prematurely due to force majeure or due to official orders for which the organizer is not responsible (e.g. due to measures to combat the COVID-19 pandemic), or if there are changes in the execution of the event to which the Organizer is obliged for safety reasons, Wechselszene Sven Hindl GmbH is not liable for damages towards the participant. In these cases, the organizer is entitled to withdraw starting rights, to exclude individual or all participants from the event and/or to withdraw from the contract. In these cases, the participation fee will not be reimbursed.
2.12 The organizer reserves the right to change the execution of the event, for example due to official orders for which he is not responsible. For the rest, point 2.11 applies accordingly.
If the organizer is entitled to reduce the number of participants due to force majeure or due to an official order for which he is not responsible or is obliged for safety reasons, the starting places will be allocated according to the officially prescribed maximum number after the date of receipt of the registration of the participants.
